PAT Testing & The Law
A duty of care to ensure the health, safety & welfare of all persons using the premises
It is clear from all the Acts and Regulations shown above that as the employer or owner of a business premises you have an obligation to ensure that all equipment used in, or associated with the work place, is safe. This covers the largest down to the smallest pieces of equipment. Many people believe that laws are there to catch you doing something wrong so a punishment can be given, however they are actually there to help people know where the boundaries are and what is expected of them in their position.
If someone gets hurts & you've failed to show a duty of care you are liable
"PAT Testing is not a legal requirement" but it is THE certified way of ensuring that equipment is safe to use and complies with the relevant legislation. So, by having your equipment regularly PAT Tested, you are demonstrating due diligence of your legal obligations.
